Mullin Calls Out Social Media Platforms for Allowing Content-Based Speech Discrimination Under Section 230

At a hearing before the House Energy and Commerce Subcommittee on Communications and Technology, Congressman Markwayne Mullin (OK-02) called out social media sites, such as Facebook and Twitter, for becoming political platforms that engage in content-based speech discrimination online. These social media platforms, among others, have abused their legal protections under Section 230 of the Communications Decency Act. Mullin brought attention to the many instances of these platforms hiding behind Section 230 protections, all while silencing conservative voices and viewpoints with which they disagree.

Section 230 of the Communications Decency Act provides limited federal immunity to providers and users of interactive computer services. The law generally precludes providers and users from being held liable for information provided by a third party, but it does not prevent them from being held legally responsible for information they have developed or for activities unrelated to third party content.
